Food Allergies and Intolerances 

  • Please take a moment to read this FOOD ALLERGY DISCLAIMER and please discuss this further if it affects you before placing an order. 
  • Cupcake Cottage is NOT an allergy-free kitchen.  Due to the nature of my business and flavour combinations available I cannot guarantee that my products are free from ingredients that may affect those with food allergies. At Cupcake Cottage Cakes I recognise the seriousness of food allergies and therefore I may reserve the right to decline any orders for clients with serious food allergies.  Cupcake Cottage will not assume any liability for adverse reactions to my cakes or treats. 
  • The following ingredients are used in my kitchen: Milk and other dairy products, Eggs, Nuts: peanuts, pecans, walnuts, almonds, cashews, coconut, Wheat and gluten and sometimes alcohol. 
  • Please note my fruit cakes contain ground almonds, as does the marzipan.
  • Nut allergies – I can make “nut free” cakes, although I cannot guarantee that the products in the ingredients come from a nut free environment.  (i.e. – flour, sugar, etc.)
  • The only cake that will contain a marzipan coating under the icing is a fruit cake and spheres, unless it is specifically requested on other cakes.
  • Cupcake Cottage can bake cakes with gluten free flour upon request but will not guarantee such cakes as 100% “gluten free” due to the kitchen not being allergy free and as such these cakes are purchased at your own risk and Cupcake Cottage will not assume any liability for any adverse reactions to these cakes. 
  • Regretfully Cupcake cottage is unable to provide vegan cakes or treats. 

Booking Terms and Conditions 

  • Payment can be made via our online bank account: Emma Connor Code: 309458 Account no: 04235360. Or via Paypal: cupcakecottageivybridge@hotmail.co.uk 
  • The balance of the cake must be paid at the latest, 3 days before the collection / delivery date; otherwise this could affect delivery of the cake.  If the final payment is not received a reminder may be sent, if no further payment is made we will consider the order cancelled and the deposit lost.
  • Cancellation by the customer: If the order is cancelled, your deposit is non-refundable and non-transferable; payment is required for any and all expenses already incurred on behalf of the finished product.  This is to cover monies lost as I will have turned away other business for your order, it is very unlikely we could re-fill the date at such short notice. 
  • When travelling with the cake: DO NOT place the cake on a seat in the car, seats are slanted and can damage the cake. The cake should be placed either in the boot or the foot well of the car on a non-slip mat (if you do not have one, please ask). Extra care should be taken when driving as some elements may be delicate. I cannot take any responsibility for damage to cakes when collected and transported by my customers.
  • All cakes / cupcakes should be placed on a flat surface and stored at room temperature in the box provided. They should be kept out of direct sunlight. Freezing or refrigerating our cakes or cupcakes is not recommended. Please note cupcakes should be consumed within 2 days and cakes within 3 days.
  • Once the cake has been delivered / collected  and set up I can take no responsibility of any events that happen thereafter.  This also includes the cake “drying out”. If the cake is cut and left uncovered by your catering staff the cake will dry out. I can therefore take no responsibility for this happening.  Please note I always take a photograph of the cake, once delivered and set up.
  • Please note I am registered with the department of environmental health and have a hygiene rating of 5, which is the highest grade, and trading standards, South Hams District Council, and I adhere to their rules and regulations for your safety. I regularly update my food hygiene certificate and always hold current liability insurance.
  • If a customer would like fresh flowers, rather than sugar flowers on their cake, it is the customer’s responsibility to source the florist/flowers, unless specifically agreed with Cupcake Cottage. Once the cake has been set-up at the venue, and the cake has been signed for, I do not take any responsibility for any damage to the cake from the fresh flowers, or the placement on the cake of the fresh flowers. You acknowledge that fresh flowers are not a food product, and may contain pesticides, insects, dirt, or other contaminants. Cupcake Cottage takes no responsibility for the flowers being food-safe. 
  • I can take no responsibility for any extra decoration that is added on the cake or stand, or around the cake/stand, after setting the cake up.
  • If you require a mature fruit cake, then 3 months’ notice must be given, for the cake to mature and be ‘fed’. Please also inform at this time whether you require nuts in the fruit cake or not.  
  • Most cakes contain small proportions of inedible items; it is the client’s responsibility to ensure these are removed by your caterer/guests before consumption e.g. cake toppers, Support dowels in tiered cakes, ribbon, wires in sugar flowers, Swarovski crystals, flower picks & flower tape etc. 
  • Plastic cake dowels are used in some tiers of cakes, and these are specialist dowels for cakes and are placed into the cakes to support the layers above.
  • It may also be possible that if you have figures of your cake, these may contain small pieces of cocktail sticks, therefore these are not classed as edible, however where possible we use dried spaghetti which is edible.
  • To achieve certain effects on cakes, some pieces of icing, maybe be “hard”, and are classed as a non-edible item.  No responsibility can be taken if any teeth get damaged when eaten.
  • I can take no responsibility of the quality of the stand or an uneven table/floor that is provided by the hotel.
  • The delivery charge will be agreed at the time of booking and will be shown in your booking confirmation letter. In the unlikely event of adverse or extreme weather conditions (such as snow or floods) which may make the delivery venue inaccessible, or for other unforeseen complexities outside of our control, we cannot be held liable in any capacity. 
  • If you have hired a stand from me, I will require delivery of the item to my home address within 7 working days.
  • If any of the stands get damaged or lost, there will be a charge to cover a replacement.
  • If a stand is not returned and I have to collect it, there will be a charge made, depending on distance travelled/time taken, please arrange this prior to the event if you know you cannot return the stand.
  • My usual business hours are – Monday – Friday – 9.00am – 5pm, Saturday – 9.30am – 1.00pm, and Sundays CLOSED.  Some Saturdays I am out and about delivering and setting up wedding cakes. Please note that I operate an appointment only service.
  • I recommend extreme caution if you are considering a cake decorated with chocolate for a summer event (May-September). I cannot accept responsibility for any melting of the cake once it has left our possession, as we have no control over the environment / venue temperature. We can however advise you of designs that are less susceptible to melting and do everything within our control to reduce the impact on the cake.
  • Products made by Cupcake Cottage are made by hand and accordingly there will be minor variations in appearance. All photos, illustrations and descriptions displayed on our page are for guidance purposes only.
  • I will usually photograph my cakes and we reserve the right to use any photographs for display or promotion without compensation to you.
  • I am not able to “exactly” copy another person’s work, but a design can be made “similar”.  This is due to copyright.
  • If you wish to match a specific colour, then a swatch of material is required.  I will always do my best to match colour, although this cannot be guaranteed.
  • Please note, a number of people, including myself, regularly quality test all my cakes, to ensure quality control, Complaints are extremely rare in the world of cakes and we have never had a complaint as yet. Some complaints may require further investigation and an immediate refund may not always be possible. Cakes, or part of cakes and cupcakes, must be returned to us within 24 hours to ensure we are able to fairly assess the nature of the complaint. The cake must have been stored at the correct temperature and in the box we supplied, out of the sun and away from damp conditions or heat. If you are complaining for a refund you must return at least 75% of the uneaten product within 24 hours of delivery.
  • If you are having different flavoured cakes, sometimes because of the density of the cake, I am unable to trim them to make them exactly the same depth as the other cakes.  This is unavoidable.
  • If I have to leave the cake in direct sunshine, I cannot take any responsibility for the quality of the cake after I leave it.
  • Please make sure you read carefully the details on booking confirmation letter, as alterations need to be made at least two weeks before the event.
  • If you require me to copy certain aspects of different cakes – PICTURES MUST BE LEFT WITH ME AT THE TIME OF BOOKING, or shortly thereafter.

Coronavirus / COVID-19

  • If the event is cancelled due to the coronavirus, I cannot refund the non-refundable deposit made but any other payments that have been made toward the cake can be refunded. 
  • If I, or any of my close family contracts the illness and I am unable to complete your order, the non-refundable deposit will be refunded and I will give you as much notice as possible.
